Purpose

Prom95 S.L. (“PROM95”) (hereinafter, the “Provider”), as the entity responsible for this website, makes this document available to users in order to comply with the obligations set out in Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), and to inform all website users of the terms and conditions governing the use of the website.

By accessing this website, any person assumes the role of user and undertakes to comply strictly with the provisions set out herein, as well as with any other applicable legal requirements.

The Provider reserves the right to modify any information that may appear on the website at any time, without any obligation to give prior notice or to inform users of such changes. Publication on the Provider’s website shall be deemed sufficient notice.

Use of the website

This website provides access to information, services, programs and data (hereinafter, “Content”) available online. Through the website, users are provided access to and may use various services and content made available by PROM 95 and/or by third parties. Users access and use the website at their own risk and accept full responsibility for doing so.

Users undertake to use the website and any content and/or services made available through it diligently and appropriately, strictly for personal, private and non-commercial purposes. By merely accessing the website, users agree to:

Liability

Accordingly, the Provider disclaims any liability arising from information published on its website where such information has been manipulated or introduced by a third party unrelated to the Provider.

The Provider’s website may use cookies (small information files sent by the server to the computer of the person accessing the website) to perform certain functions considered essential for the proper operation and display of the site. The cookies used on the website serve the purposes described for each of them in the Cookie Policy. In no case will cookies be used to collect personal information.

This website may redirect users to content on third-party websites. As the Provider cannot always control the content introduced by third parties on their websites, the Provider assumes no liability for such content. Nevertheless, and in compliance with Articles 11 and 16 of the LSSI-CE, the Provider makes itself available to all users, authorities and law enforcement bodies, and will actively cooperate in the removal or, where appropriate, blocking of any content that may affect or contravene national or international law, third-party rights, or morality and public order. If a user believes that there is any content on the website that may fall into this category, they are requested to notify the website administrator immediately.

This website has been reviewed and tested to function correctly. In principle, correct operation can be ensured 365 days a year, 24 hours a day. However, the Provider does not rule out the possibility of programming errors or the occurrence of force majeure events, natural disasters, strikes, or similar circumstances that make access to the website impossible.

The website—including, by way of example but not limitation, its programming, editing, compilation and other elements necessary for its operation—as well as the designs, logos, text and/or graphics, are the property of the Provider or, where applicable, the Provider holds a license or express authorization from the authors. All website content is duly protected by intellectual and industrial property regulations and, where applicable, registered in the corresponding public registries.

Regardless of the purpose for which it is intended, any total or partial reproduction, use, exploitation, distribution or commercialization requires the Provider’s prior written authorization. Any previously unauthorized use by the Provider shall be considered a serious infringement of the author’s intellectual and/or industrial property rights.

Designs, logos, text and/or graphics not owned by the Provider that may appear on the website belong to their respective owners, who are responsible for any potential dispute that may arise in relation to them. In any case, the Provider has the express prior authorization of the relevant owners.

Applicable law and jurisdiction

The relationship between PROM 95 and the user shall be governed by current Spanish law, and any dispute shall be submitted:

To the courts and tribunals of the city of Benidorm (or, if there are no commercial courts in that city, to those of Alicante) when the user is a business entity.
To the courts and tribunals of the city of the user’s domicile when the user is a consumer, in accordance with applicable law.
